Aquesta normativa desenvolupa les mesures contemplades i descrites en la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?lang=ca&amp;id=BOE-A-2023-5366&amp;tn=1&amp;p=\">Llei 4\/2023<\/a>, establint per a les empreses de m\u00e9s de cinquanta persones treballadores una s\u00e8rie d&#8217;obligacions espec\u00edfiques amb la finalitat de garantir que els entorns laborals siguin inclusius i lliures de discriminaci\u00f3. Aquestes mesures han de negociar-se i incorporar-se en els convenis col\u00b7lectius o acords d&#8217;empresa en un termini de tres mesos des de l&#8217;entrada en vigor de la norma, i han definit un contingut m\u00ednim de les mesures.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Aspectes claus del Pla LGTBI<\/strong><\/h3>\n\n\n\n<p>Les mesures negociades en els Plans LGTBI han de tenir en compte els seguents punts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Igualtat de tracte i no discriminaci\u00f3: es fomentar\u00e0 un entorn laboral inclusiu i s&#8217;eliminar\u00e0 qualsevol forma de discriminaci\u00f3 per orientaci\u00f3 sexual, identitat o expressi\u00f3 de g\u00e8nere.<\/li>\n\n\n\n<li>Acc\u00e9s a l&#8217;ocupaci\u00f3: s&#8217;assegurar\u00e0 que els processos de selecci\u00f3 siguin objectius, per a garantir la igualtat d&#8217;oportunitats per a les persones LGTBI.<\/li>\n\n\n\n<li>Promoci\u00f3 professional: s&#8217;establiran criteris clars i basats en m\u00e8rits per al desenvolupament professional.<\/li>\n\n\n\n<li>Formaci\u00f3 i sensibilitzaci\u00f3: les empreses han d&#8217;incloure m\u00f2duls formatius sobre drets LGTBI i fomentar l&#8217;\u00fas de llenguatge inclusiu entre la plantilla.<\/li>\n\n\n\n<li>Beneficis socials i permisos: tamb\u00e9 \u00e9s important garantir que els beneficis i permisos siguin accessibles per a totes les configuracions familiars.<\/li>\n\n\n\n<li>Entorns diversos i assegurances: es promou la diversitat en les plantilles i s&#8217;exigeix la creaci\u00f3 de protocols contra l&#8217;assetjament cap a les persones LGTBI.<\/li>\n\n\n\n<li>R\u00e8gim disciplinari: les empreses han d&#8217;incloure sancions espec\u00edfiques per a comportaments que atemptin contra la llibertat sexual, orientaci\u00f3 o identitat de g\u00e8nere.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>El protocol contra l&#8217;assetjament cap a les persones LGTBI<\/strong><\/h3>\n\n\n\n<p>Com s&#8217;esmenta en els dos \u00faltims aspectes comentats, una de les disposicions m\u00e9s rellevants \u00e9s <strong>l&#8217;obligatorietat de comptar amb un protocol per a prevenir i actuar contra l&#8217;assetjament o la viol\u00e8ncia cap a les persones LGTBI<\/strong>. Aquest protocol ha d&#8217;aplicar-se no sols al personal de l&#8217;empresa, sin\u00f3 tamb\u00e9 als prove\u00efdors, clients i persones candidates en processos de selecci\u00f3 que interactuin amb l&#8217;empresa, com succeix amb el Protocol d&#8217;Assetjament Sexual. A m\u00e9s, l&#8217;incompliment d&#8217;aquestes obligacions pot ser considerat una infracci\u00f3 greu i estar\u00e0 sancionat amb multes que oscil\u00b7len entre els 751 \u20ac i els 7.500 \u20ac<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>En conclusi\u00f3:<\/strong><\/h3>\n\n\n\n<p>Aquest Reial decret suposa un avan\u00e7 significatiu cap a la igualtat en l&#8217;\u00e0mbit laboral, promovent un entorn m\u00e9s inclusiu i respectu\u00f3s per a tots. Les empreses no sols han d&#8217;adaptar-se a aquestes obligacions per a evitar sancions, sin\u00f3 tamb\u00e9 per a fomentar una cultura organitzativa que valori la diversitat i garanteixi un ambient laboral equitatiu i segur.
