Aquesta mesura, impulsada per les reformes introdu\u00efdes al <a href=\"https:\/\/www.boe.es\/buscar\/act.php?lang=ca&amp;id=BOE-A-2019-3244&amp;tn=1&amp;p=\">Reial Decret Llei 6\/2019<\/a> i el <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2020-12214\">Reial Decret 901\/2020<\/a>, t\u00e9 com a objectiu garantir la igualtat efectiva entre dones i homes al lloc de treball. No obstant aix\u00f2, la seva implementaci\u00f3 ha estat plena de reptes i dificultats que, encara avui, impedeixen que moltes empreses compleixin amb aquesta normativa.<\/p>\n\n\n\n<p>A Espanya, amb un teixit empresarial format majorit\u00e0riament per petites i mitjanes empreses (pimes), moltes de les quals tenen entre 50 i 100 persones treballadores, el volum d\u2019empreses obligades a complir amb aquesta normativa s\u2019ha incrementat significativament. Aquesta caracter\u00edstica ha afegit complexitat al proc\u00e9s d\u2019implementaci\u00f3, especialment per a aquelles organitzacions amb recursos limitats per afrontar aquest tipus d\u2019obligacions legals, especialment per a les empreses sense representaci\u00f3 legal de les persones treballadores (RLPT), que van trobar-se amb un buit estructural que dificultava la negociaci\u00f3 dels Plans d\u2019Igualtat. Si b\u00e9 les empreses podien sol\u00b7licitar representaci\u00f3 sindical, aquesta situaci\u00f3 va comportar una allau de sol\u00b7licituds als sindicats m\u00e9s representatius, que sovint no van poder respondre amb prou celeritat.<\/p>\n\n\n\n<p>De forma paral\u00b7lela, es va definir la necessitat de registrar els Plans d\u2019Igualtat al REGCON, i les autoritats laborals encarregades de supervisar i validar el registre d\u2019aquests acords es van veure desbordades, amb demores que encara avui persisteixen en molts casos.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>El que ens ha marcat la jurisprud\u00e8ncia<\/strong><\/h3>\n\n\n\n<p>En aquest escenari complex, la jurisprud\u00e8ncia ha esdevingut un aliat clau per donar seguretat jur\u00eddica a les empreses que han fet tot lo possible per complir amb la normativa. Els tribunals han establert dues vies principals que contribueixen a desbloquejar aquestes situacions de bloqueig:<\/p>\n\n\n\n<p><strong>Plans d\u2019Igualtat negociats unilateralment<\/strong><\/p>\n\n\n\n<p>Els tribunals han validat Plans d\u2019Igualtat elaborats unilateralment per empreses quan s\u2019ha pogut acreditar que aquestes han fet esfor\u00e7os reiterats per contactar amb els sindicats sense obtenir resposta. Aquesta jurisprud\u00e8ncia es basa en el principi de bona fe negociadora, reconeixent que no es pot penalitzar una empresa si ha actuat diligentment en un context d\u2019impossibilitat de disposar de RLPT.<\/p>\n\n\n\n<p>Un exemple destacat \u00e9s una sent\u00e8ncia del Tribunal Superior de Just\u00edcia de Madrid (STSJ Madrid, 18 de mar\u00e7 de 2023), que va considerar v\u00e0lid un Pla d\u2019Igualtat negociat de manera unilateral despr\u00e9s de reiterats intents fallits de contactar amb els sindicats. Aquesta resoluci\u00f3 va marcar un precedent per a casos similars.<\/p>\n\n\n\n<p><strong>Silenci administratiu positiu<\/strong><\/p>\n\n\n\n<p>La jurisprud\u00e8ncia tamb\u00e9 ha confirmat l\u2019aplicaci\u00f3 del principi de silenci administratiu positiu en el proc\u00e9s de registre dels Plans d\u2019Igualtat. Segons aquest principi, si l\u2019Administraci\u00f3 no emet una resoluci\u00f3 denegat\u00f2ria en el termini de tres mesos despr\u00e9s del registre, el Pla es considera aprovat de forma autom\u00e0tica. Aquesta praxi, avalada per sent\u00e8ncies com la del Tribunal Superior de Just\u00edcia de Catalunya (STSJ Catalunya, 15 de juny de 2022), ofereix una soluci\u00f3 pragm\u00e0tica per agilitzar la implementaci\u00f3 dels Plans d\u2019Igualtat davant la sobrec\u00e0rrega de les autoritats laborals. <\/p>\n\n\n\n<p>Tot i que aquestes resolucions judicials han estat benvingudes com a mecanisme per desencallar situacions problem\u00e0tiques, tamb\u00e9 plantegen limitacions. La validesa de Plans d\u2019Igualtat negociats unilateralment pot ser objecte de disputes futures, especialment si es percep que no reflecteixen un consens ampli. Aix\u00ed mateix, el silenci administratiu positiu, tot i aportar seguretat jur\u00eddica, pot deixar plans aprovats sense la supervisi\u00f3 necess\u00e0ria per garantir la seva qualitat i efic\u00e0cia.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>En conclusi\u00f3<\/strong><\/h3>\n\n\n\n<p>La jurisprud\u00e8ncia ha demostrat ser un instrument clau per facilitar la implementaci\u00f3 dels Plans d\u2019Igualtat; no obstant aix\u00f2, \u00e9s imprescindible que les empreses continu\u00efn treballant proactivament per garantir que aquests plans no nom\u00e9s compleixin amb els requisits legals, sin\u00f3 que tamb\u00e9 contribueixin efectivament a la igualtat real als llocs de treball.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\">Consulta tota la jurisprud\u00e8ncia aqui:<\/h4>\n\n\n\n<p><strong><em>Respecte al silenci administratiu positiu<\/em><\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/www.poderjudicial.es\/search\/AN\/openDocument\/eb8a7bbd22964302a0a8778d75e36f0d\/20250116\">STS, a 20 de desembre de 2024.
